METHODOLOGY OF RESEARCH OF LEGAL PRINCIPLES OF ORGANIZATION OF PUBLIC CONTROL IN THE FIELD OF PUBLIC GOVERNANCE

Abstract

Given the need for comprehensive legal regulation of the subjects of public control in the field of public administration, it is necessary to scientifically search for organic patterns of origin and functioning of such administrative relations. It is obvious that, given the novelty of such an institution in Ukrainian law, today there are many legal gaps that cannot be covered by referring to a specific rule of law. It is a well-established international practice of solving such problems to use a system of principles - norms of direct action, which, given their natural and legal nature, establish the main directions and trends in legislation in certain industries and institutions. That is why it is important to study the administrative and legal foundations of the organization of public control in the field of public administration, a detailed analysis of which will form a conceptual basis for interaction between public administration and civil society. In this regard, Ukraine is a typical representative of the continental legal system with well-established approaches to the normative concept of law, skeptics note that the principles of law are not an effective mechanism for legal regulation in our country. Thus, of course, it is difficult to imagine a situation where the bureaucracy of public administration would meet the needs of the public in the process of public control, motivating such actions not by a normative or bylaw - but by an ephemeral principle.However, such a model of cooperation is idealistic for the development of relations between the state and civil society, it forms legal awareness in this area, performs a preventive function to prevent violations of legal rights and interests. And, finally, such a model is generally accepted in developed European countries. Given the above, there is a need for a comprehensive study of the administrative and legal framework for the organization of public control in the field of public administration. The aim of the article is to analyze the methodology of research of legal bases of organization of public control in the sphere of public administration. The study found that the methodology creates a basis for the study of all components of a particular topic, contributes to its structured consideration and logical presentation of the material. Moreover, the disclosure of the methodological foundations of the study of public control in the field of public administration will help to understand the technique of scientific analysis, finding ways to analyze all issues in the field of research, the correctness of comparative law, system-structural and other approaches.
